All bookings accepted by Rose & Pristine Villa are subject to these conditions which are deemed to have been accepted in full by the hirer and all persons in their party.

1.     What IS Included

The villa rental includes the cost of delivery of bed linen and towels including one bath towel, one beach towel and one hand towel per guest provided every 3 days, end of stay villa cleaning, water, electricity, maintenance of swimming pool and garden. Any defects or deficiencies must be reported within 48 hours of your arrival. After this time it will be assumed that everything is in order.

2.     What IS NOT Included

The villa rental prices do not include personal, travel and cancellation insurance, travel, transportation, airport transfers, full resort representation or mid-stay cleaning of the villa.  Local telephone, cable TV, DVD player, air conditioning, BBQ, garden furniture, etc. are free items, therefore the availability or function of any such item cannot be guaranteed.  In most cases cable will only receive a limited number of channels and can be unreliable depending on the weather.

3.     Confirmation of Booking

Your booking is only confirmed on receipt of your deposit and confirmation will be sent to you by email with an invoice stating the balance amount owing and due date the final balance is to be paid.

4.     Special Event Booking

Regular bookings are for vacation purposes and special permissions and charges apply for functions where the number of people in attendance exceeds the capacity of the villa.

5.     Transfer of Bookings at Your Request

Should you be prevented from travelling due to serious injury or death, or serious injury or death of a close family member, jury service, government restrictions or a similar event- you may transfer your booking to someone else or reschedule for a later date. This transfer request will only be processed if submitted to us in writing accompanied by the paperwork, which has already been issued, and/or any final payment which is still outstanding.

6.     Cancellation of booking

You may cancel your booking at any time, providing that the cancellation is communicated in writing. If this incurs, deposits will be refunded as outlined below. In order to compensate Rose & Pristine Villa Management for the time and effort involved in making a booking and the loss of other potential bookings that have been turned down once a booking has been confirmed:

Notice of cancellation must be received by Rose & Pristine Villa Management in writing.

Our cancellation levy charges on the deposit for the ‘Period Prior to Arrival Date Cancellation Charge’ follows:

·     Under 30 days: 50%

·     21 days or less: 75%

. 14 days or less: 100%

Note: Payments on discounted bookings are non-refundable.

7.     Deposit

Please note that if the reason for cancellation is covered under your travel insurance, you may be able to reclaim these charges.

A deposit of 50% of the total cost is required to secure your booking, due within 7 days of booking confirmation & invoice sent. Your booking must be made by facebook message, instagram message, email, or verbally by telephone (followed by written confirmation).

 If your booking is made 1 month or less before the hire commencement date it must be accompanied by full payment.

 Should we not receive your payment within 7 working days (unless the booking is sooner) then your provisional booking will be released unless we are notified and agreed to otherwise.

8.  Final Payment

The balance must be paid a minimum of 1 month prior to the hire commencement date. For payment instructions refer to Section 10- Forms of Payment.

If your booking is made 4 weeks or less before the hire commencement date, it will be deemed provisional for 3 days until full payment is received. If we do not receive the balance by the third day we shall be entitled to cancel the booking without prejudice.

9.  Form of Payment

All payments prior to your arrival date shall be paid by one of the following payment methods unless otherwise agreed. Payments can be made in US Dollars or TT Dollars.

We accept:  Wire transfer/ Direct Deposit

If required, our bank account details will be provided once the booking form has been received and confirmed.

When arranging an international payment into our bank account for the villa rental the Payee is responsible for the payment of any associated bank charges charged by either the Payee or the Beneficiary bank. When refunding the damage waiver deposit due to you on completion of your rental, any associated bank charges charged by either the Payee or the Beneficiary bank will be paid for by the Beneficiary.

10.  Alterations and Cancellations by Us

In the unlikely event that a villa becomes unavailable due to circumstances beyond the control of Rose & Pristine Villa, the hirer will be offered alternative accommodation, if available or a full refund of monies paid at that time. In the event that no suitable accommodation can be offered then a full refund of monies already paid for the villa rental will be refunded. Any refund is restricted to the villa hire costs and we are not liable for any cancellation or administration charges for travel arrangements, etc.

11.  Check in and Check out times

The villa will be available for occupation from 3.00 pm local time on the day of arrival and must be vacated by 11.00 am on the day of departure.

12.   Keys, Directions and Local Contact Numbers

Detailed instructions for key collection and directions to the villa will be provided at least 1 week prior to the rental commencement, together with a local contact telephone number of our on the ground house manager should you have any problems whilst at the villa. Guest should contact grounds manager once there is a change of flight/ferry arrival times or changing the meeting time at the villa (should you decide to rent a car, buy groceries etc, before checking in)

13.   Occupancy

Only persons listed on the booking form may occupy the villa. The villa cannot be re-let or sublet to any other group/party or individual without the written approval of management.

Under no circumstances may more than the maximum number of persons specified in the villa description, or booking form, occupy the villa except by prior written agreement. Rose & Pristine Villa, or their representatives, reserves the right to refuse admittance to the villa to the hirer and their party if they are in breach of this condition.

14.  Hirer’s Responsibility

The hirer is responsible for taking all reasonable care of the property and its contents. At the end of the hire period, the property and its contents, including all equipment, furniture, utensils, etc must be left clean and tidy which includes the crockery and cutlery cleaned and stored in the appropriate cupboards and ensures that the cooker, oven, fridge, toaster, toaster oven and microwave are clean. The hirer shall ensure that no member of the party engages in any activity in or around the villa and swimming pool which may cause damage, offence to the neighbours, pollution to the water or damage to the structure or filtration equipment, this includes unacceptable anti-social behaviour. The hirer shall also ensure that the barbecue is cleaned and that all garbage is cleared away from the property and placed in the dustbins provided.

 15.   Damage to Villa and its Contents

Except in the case of normal wear and tear, the hirer will be responsible for making good any damage to the villa or its contents which has occurred due to negligence, willful damage or irresponsible behaviour on the part of those occupying the villa or their guests. Such damage must be immediately reported to Rose & Pristine Villa or its representative. The cost of the replacement or damage must be paid for by the hirer to the owner either directly or via their agent (Villas of Tobago). A figure of one day rental fee (unless otherwise advised) is held against damage to the property, furnishings, excessive cleaning requirements or unnecessary service call-outs.

A damage waiver deposit of one night’s booking fee is normally required. This amount will be added to your invoice. The Full damage waiver deposit will be refunded to the customer within two (2) weeks of departure date less the cost of any damage.

The customer is responsible for leaving the property in good order and condition. The customer further undertakes to pay for any damages or losses incurred during occupation.

Rose & Pristine Villa Management reserves the right to repossess the property, at any time, if the customer or a member of the party has caused excessive damage or disruption.

16.  Villa & Pools

Diving into the swimming pool is strictly forbidden. Rose & Pristine Villa Management cannot at any time accept liability under any circumstances for any instances that may affect any member of your group’s personal well being, including personal injury, illness or death caused by the use of the pool.

17.  Pets

Generally we do not accept animals at our villa. However, there may be certain exceptions e.g. if you or someone in your party requires their service dog. You must inform Rose & Pristine Villa Management prior to booking the villa to obtain written permission from management.

18.  Smoking           

Smoking is strictly prohibited inside the villa. Precaution must be taken when smoking outside the villa, so that villa property is not damaged or destroyed. All cigarette butts must be properly and safely disposed of.

19.  Responsibilities

Neither Rose & Pristine Villa nor their representatives can be held responsible for any circumstances beyond their control including, but not limited to mechanical breakdown, illness, swimming pool maintenance, emptying of swimming pool or hot tub for necessary maintenance, failure of any public service supply.

 The hirer responsible for booking undertakes that no person will suffer anything to be done which would endanger the policy of the villa owner’s insurers in respect of the villa and its contents which might make the same void or voidable.

 20.  Insurance

The villa hire cost does not include any personal insurance cover of any kind. It is a condition of booking that insurance is taken out against cancellation and it is strongly recommended that personal accident and medical insurance is also taken out for everyone staying at the villa.

21.  Injury and Damage

We do not have any responsibility to compensate you for any personal injury, illness, death, loss or damage of whatever nature suffered by you or any member of your party during the booking period or thereafter.

22.  Rights of Access

Rose & Pristine Villa, their representatives or their sub-contractors have the right of access to the villa at any time with due regard to the convenience of the hirer for the purpose of linen changes, inspection of the property and to carry out any essential or routine repair or maintenance work.

23.  Building Work

In the event of building works taking place by local authorities, private developers or neighbours, it is important to note that we are not responsible for such work, are unable to stop such work taking place or unable to control the level of noise, neither can we be responsible for any building works that take place during a holiday.

24.  Complaints

In the unlikely event that you have a complaint about the villa or its contents whilst on vacation, it must be reported immediately either to our grounds manager, via our Facebook/ Instagram accounts, email, or Airbnb inbox so we can take reasonable steps to resolve the matter. Neither Rose & Pristine management nor their representatives shall have any liability for any complaint submitted after the completion of the hire period.

25.  Force Majeur

We regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by ‘force majeur’. In these Terms and Conditions of Hire, ‘force majeur’ means any event which we or the supplier of the service(s) in question could not, even with due care, foresee or avoid. Such events may include, but are not limited to, war, threat of war, civil commotion or strife, hostilities, strikes or other industrial disputes, natural disasters, fire, acts of God, terrorist activities, quarantine, epidemics, weather conditions, government action or other events outside our control.

 26.  Accuracy of Information

Rose & Pristine Villa always takes a great deal of care to ensure that the information and photography provided on our website and social media are correct to the best of our knowledge. However from time to time we may make changes to details like decoration, furniture and fittings. All information supplied by Rose & Pristine Villa is given in good faith and is based upon information available at the time. All reasonable measures have been taken to ensure accuracy, but Rose & Pristine Villa and their representatives are not liable for any variation however caused.

27.   Law and Jurisdiction

The contract is made on the terms herein and is between the property owner and the hirer.  Any disputes arising from the hire of the property will be resolved between the hirer and the owner. Where legal action is contemplated our authority must be obtained prior to commencement of proceedings. Our costs in respect of the above on behalf of you and your party shall not exceed the total cost of the amount paid for the villa rental.

This agreement shall be governed by the laws of the Republic of Trinidad and Tobago, to which both parties expressly submit.
